Apple Hit with Stacks Lawsuit
by , 8:50 AM EDT, March 19th, 2008
Mirror Worlds has hopped on the Apple lawsuit train and is suing the company for infringing on its time-based stack or stream file organization patents. Like so many other suits against Apple, this one was filed in the Eastern District of Texas -- a favorite for patent trolls, according to InformationWeek.
The lawsuit alleges that Mac OS X features including Time Machine and Cover Flow are described in patents Mirror Worlds owns, and are being used without proper licensing.
The company opened its doors in 1997 and later filed its patents, which may prove to be a problem in proving that they are valid. Apple's now defunct HyperCard first appeared in 1987 with many of the same concepts Mirror Worlds claims, which means the Cupertino company could have the patents invalidated as prior art.
Mirror Worlds was based out of New Haven, CT, and closed its doors in 2004. It's filing against Apple from March 14, 2008, however, was filed in Texas Eastern District Court. The court is well known for its steep penalties and for favoring plaintiffs in patent cases.
Since neither company is headquartered in Texas, it seems likely that Mirror Worlds is hoping the venue will push Apple into an out of court settlement.
Apple was hit with another patent lawsuit last week when ZapMedia filed a case against the company with an iPod and iTunes-related claim. Like Mirror Worlds, that case was filed in the Texas Eastern District Court.
Apple has not commented on either case.

Apple Reaps What They Sow
Has it occurred to anyone that Apple is getting sued because they have a big appetite for other's patent property and a big ego that gets in the way of acquiring the rights to the patent properties they need to succeed in the market?
Have you considered that Apple gets sued after they have refused a legitimate offer for a license?
Or have you considered that Apple's membership in the Coalition for Patent fairness and PIRACY, aka. the Piracy Coalition is a good indication that birds of a feather do flock together?
Some companies start as inventors, and some start as parasites on those who have invented. Eventually they end up alike, one group never being inventive and the second losing the ability to invent as they age. Both will try to substitute quanity in patent filing for the quality of inventions they are incapable of producing. It does not work.
All Piracy Coalition members fit one of these profiles. Tech companies who are past their prime, insurance and banking collectively have no shame!
What they very good at producing is innovating media hype which obfuscates the reality of their existence. Their multi-million dollar “troll†campaign is a perfect example of this. They paint their victims as “trolls†while the courts are finding their conduct so egregious that they are handing down staggering judgments which are generally being upheld by higher courts. This is what happens to those who are caught lying, cheating, and stealing and no amount of public relations painting their victims as evil “trolls†can change the facts of these cases.
Personally I think that it is a shame that Piracy Coalition members have failed to learn the lesson that inventors and the courts are teaching. It is all about conducting one’s business in an ethical manner!

Nice comments rjrilley5000, but did it occur to you to comment on the specifics of the case rather then just a cut and paste rant that would fit any patent case you happen to have a problem with? If Apple is guilty it should pay, if not so be it; but at least be informative.
Well at least he registered to post, through he kind of writes like a lawyer.
Anyway, it is in the legal system now so time will tell if the case has merit or not.
How about the other lawsuits against Apple filed in that court's jurisdiction, any news about how they turned out?

.. the only innovations at Apple are the creative stealing others intellectual property thinking they can bully their way into getting away with it and finding Red Chinese low bidder contractors that do the actual design and manufacture of all their Mac-Premium products that Stevie likes to pretend are Apple MADE. Apple hasn't engineered of manufactured ANYTHING since the 80's and that's a FACT.
Apple designs their hardware in Cupertino. It is manufactured in China (as is almost every other PC in the world) based on Apple's designs.
What you have stated is not a FACT. It is trolling.

Prior art does not automatically invalidate a patent. Besides, Apple has a known history for violating patents flagrantly, so I have no sympathy for the company and it's legal woes.
Apple certainly has a known history of being SUED for allegedly violating patents (as does MS and almost any large corporation, especially in the computer and software industries). As to whether or not all of these suits are valid is another thing altogether. Is there any link to a valid document or listing of patents it has been proven they have violated? Just curious, as we always hear tell of "evil Apple" stomping all over the little guy's patents, but many of these suits seem to fall off the face of the earth with no report of how they actually ended up. And many really do seem like patent trolls just looking for a way to dig into somebody's deep pockets.
