Psystar Misses Another Deadline to Respond, Given Extension

Psystar has missed another deadline to respond to Apple's complaint, but has been given an extension to August 28th. This is not an unusual event, and extensions for filing are routinely granted.

An attorney who watches the case told TMO that Psystar's attorneys came in late, and such an extension is reasonable to allow them to prepare for such a complex case.


However, now that two extensions have been granted, that's likely the limit of the court's tolerance unless Psystar and its attorneys come up with a very good reason. The next deadline for a response is Aug 28, and more should be known at that time.

Apple is suing Psystar for violation of its shrink wrap license, trademark and copyright infringement. Apple's Mac OS X license says that the OS can only be installed on Apple labelled computers, but in May 2008, Psystar started shipping their own Mac compatible PCs with Mac OS X pre-installed.

I guess you think it is OK for a company to steal another companies product and use it for it's economic gain. It isn't as if Apple is going after regular people wanting to install OSX on a PC. Apple is going after a company who has created nothing and is undermining Apple's business model of being a hardware company who uses software to increase hardware sales. If Pystar wins, Apple most likely will move to tier pricing for it's OS. You will see an upgrade price and a full install price. The full install price will be expensive.

I hope the little man wins. It's going to open up all sorts of hell, Pandora's box etc., I can't see how but I still hope Psystar wins.

For what reason should they win this case? Because they are illegally distributing Apple products for profit, in spite of Apple's clearly stated EULA? Or simply because they are "the little man"?

If you are in any line of work that involves content creation and copyrighted work, you'd be damn stupid to not vehemently protect your materials, which is what Apple is doing. Clearly you are not in that line of business; I hope you can at least understand the moral dilemma in things like downloading pirated music off the internet. I like a good underdog story as much as anyone else, but I will always side with whoever has rights to intellectual property. In this case Psystar is not the "little guy", they're simply thieves.

Trust me, they won't win this case. You can bank on it.

Subject: Oh dear...

I have no allegiance either way for various reasons (because they are COMPANIES for one), but it's difficult to ignore the fact that the pro-Psystar posters are able to comment without feeling the need to resort to attacking other posts, generally mouthing off etc.

Speaks volumes for the respective mentalities at play.
