Apple Gets Cease and Desist Order from Lugz

Jack Schwartz Shoes Inc, the maker of Lugz shoes, has issued a Cease and Desist order to Apple over the new iPod commercial featuring Eminem, according to AdWeek. The order claims that Apple, and its advertising agency TBWA\\Chiat\\Day, copied a commercial for Lugz shoes that aired in 2002.

The ads both feature people in black silhouette, along with an orange and red urban background, and a hip-hop style soundtrack.

Executive Vice President of Jack Schwartz Shoes, Larry Schwartz, commented "The Apple commercial uses the most powerful elements of our campaign, making the ads disturbingly similar. We are prepared to vigorously pursue all legal remedies in order to protect our rights."

Representatives from Apple and TBWA\\Chiat\\Day were not available for comment.
