Apple Lawsuit Against Psystar Filed

Apple has filed a lawsuit against Psystar, a Miami-based company that has been selling Intel computers bundled and running with Mac OS X.

The note appeared in Jorge Espinosais blog on Tuesday. The suit was filed in the federal district court for the northern district of California against Psystar on July 3.

"The suit alleges counts for violation of its shrink wrap license, trademark and copyright infringement.... Appleis shrink wrap license which comes with OSX specifically requires that the software be installed only on Apple branded computers. Psystar has previously expressed defiance at claims that it might be violating Appleis rights. Statements that Appleis license might violate US monopoly law have been attributed to Psystar employees," Mr. Espinosa wrote.

TMO notes that observers have been concerned about the long period of time from when Psystar started shipping their computers in May and this filing. Some have proposed that Apple needed time to thoroughly prepare its case, and that prediction looks to have proved correct.
