A federal court judge in San Jose, Calif. last week dismissed a class action lawsuit filed on Dec. 31, 2008 by a G5 iMac owner who said that vertical lines began appearing on his computer’s screen and eventually rendered it unusable. The plaintiff, Aram Hovsepian, was looking for US$5 million for himself and others covered by the class action lawsuit.
AppleInsider quoted Judge Jeremy Fogel as writing in his dismissal: "These type of class actions are not suitable for actions where recovery of money damages is the primary relief sought by the plaintiff. The purpose of this lawsuit is money damages. These pleading deficiencies are present despite the fact that Hovsepian has been given two opportunities to amend his complaint. Accordingly, the class actions will be struck without prejudice."
