Supreme Court Ruling Spurs Judge to Dismiss Apple Employee Pay Lawsuit

Apple employees hoping to get back pay for the time they spend undergoing bag checks with their work shifts are in for a disappointment. U.S. District Court Judge William Alsop dismissed employee lawsuits following a Supreme Court ruling in a similar case that says the security checks don't fall under paid time requirements.

Several Apple employees filed lawsuits against the company claiming they should be paid for the time after their shiftsand during lunch breaks when they have to wait for bag checks before leaving. The suits claimed employees weren't paid for about US$1,400 a year in overtime because they should've been considered on the clock during the security checks.

A similar lawsuit involving Amazon employees worked its way up to the U.S. Supreme Court where they claimed shift security checks fell under overtime pay requirements. The Justices disagreed saying the checks weren't integral or indispensable to employee job activities, according to the New York Times.

With a Supreme Court ruling in place, that made Judge Alsop's job much easier since the Apple employee case was essentially the same. This doesn't, however, mean their case is dead in the water. The plaintiffs have until January 6 to show Judge Alsop why their case should continue.

Considering how similar the Apple and Amazon cases are, it'll be a hard sell to convince Judge Alsop to let this case move forward.
