Would it be wise for Apple to refuse to license the multi-touch patents? There’s no way for Apple to kill Android, but they can make it a bit more costly for people to make the phones. Let the manufacturers split their resources between Android & WP7…and possibly WebOS. Maybe Samsung will invest more in Bada if they have to start paying for Android.

I don’t believe for a second that Apple will accept licensing fees. Damages, yes. Licensing fees, no.
It appears that Apple wants competing products to have to invent their own workarounds for the violated Apple patents. This will do two things. First, it will cost time and money. Second, it will almost certainly result in degraded product.
Apple makes its money from selling its own hardware. If others cannot use Apple’s intellectual property, their sales will suffer and Apple sales will increase. That’s how Apple will make money from patent enforcement.
